Gonzales City Councilman Gary Allen Schroeder, 46, has been indicted by a Gonzales County grand jury on a felony charge of third-degree attempted sexual assault.

The charges were filed Sept. 4, 2019 and stem from an incident that occurred on Aug. 18, 2017. According to the indictment, Schroeder reached his hand into the clothing and underwear of the alleged victim and attempted to penetrate a sexual organ with his finger “which amounted to more than mere preparation that tended but failed to effect the commission of the offense.”

Schroeder turned himself into Gonzales County Jail on Sept. 8, 2019.

Schroeder has represented District 1 on the Gonzales City Council since 2009. Schroeder gave no comment when asked about the charge.

If found guilty, Schroeder faces imprisonment in the Texas Department of Criminal Justice for not more than 10 years or less than two years. In addition to imprisonment, he may receive a fine not to exceed $10,000.

However, an indictment is merely a charge and should not be considered as evidence of guilt. The defendant is presumed innocent until proven guilty in a court of law.
